Probate is the process through which the legal affairs of a decedent are handled. It includes estate administration, such as collection and management of assets, filing of tax returns and payments of debts. Administration also requires the distribution of assets. If a decedent has a will it must be admitted into court. The estate must then be processed, within the requirements of the law, pursuant to the will. If a person dies without a will, that is “intestate,” statutes provide details on estate administration. Probate Administration involves assisting the personal representative or executor in the probate process.
