Workers’ compensation is designed to provide certain benefits, including disability, medical and vocational rehabilitation, to employees who sustain injury by accident or occupational disease arising out of and in the course of their employment. Benefits are payable regardless of fault on the part of the employer. An employee may be prohibited from recovery if willfully negligent at the time of the injury, but not if simply negligent. Workers’ compensation is the exclusive remedy for an employee against his or her employer for personal injury.
